See Exclusion 1. There is no cover where:

1. The Insured Incident began to occur or had occurred before You purchased this insurance
2. You should reasonably have realised when purchasing this insurance that a claim under this insurance might occur
3. You fail to give proper instructions to Arc or to the Adviser
4. Your act or omission prejudices Your or Our position in connection with the Proceedings
5. Adviser’s Costs have not been agreed in advance or exceeded those for which Arc has given its prior written approval

See exclusion 2. There is no cover:

1. For Adviser’s Costs incurred in avoidable correspondence or which are recoverable from a court, tribunal or other party
2. For damages, interest fines or costs awarded in criminal courts
3. Where You have alternative legal expenses cover
4. For claims made by or against Us, Arc or the Adviser
5. For any claim where at the time of the Insured Incident You were disqualified from driving or did not hold a licence to drive
6. For a claim arising from an allegation of Your deliberate criminal act or omission
7. For a claim arising from an allegation that You were in control of the Vehicle whilst under the influence of alcohol or non-prescribed drugs
8. Where Your motor insurers repudiate the Policy or refuse indemnity
9. For any claim arising from racing, rallies, competitions or trials
10. For a claim for breach of contract
11. For Adviser’s Costs beyond those for which Arc has given its prior written approval
12. For an application for Judicial Review
13. For appeals without the prior written consent of Arc
14. Prior to the issue of court proceedings, the costs of any legal representative other than those of the Adviser unless otherwise agreed by Arc. Such agreement is entirely at Arc’s discretion

Conditions

• Condition 2 provides for the resolution of disputes between You and Us
• Condition 3 provides that Arc on Our behalf may form the view that You do not have a reasonable prospect of success in the action You are proposing to take or are taking. If so, Arc may decline support or any further support.
