The former landlord of a Bolton pub is losing his fight to remain in charge, according to the Morning Advertiser.
Nick Hogan, formerly of the Swan and the Barristers pubs in Bolton, had previously lost the freehold of his premises to a local rival and has now been replaced as the licence holder and designated premises supervisor.
The Bolton News reported earlier this month that Darren Miller, owner of the Flying Flute in Bradshawgate, said that he would take ownership on September 21st despite claims from Mr Hogan that no agreement had been made.
Mr Hogan is to appear before magistrates after refusing to obey the smoking ban and Mr Miller believes that if found guilty this would break the terms of his lease - which Mr Hogan claims has 32 years left.
Mr Miller told the Bolton News: "I have exchanged contracts and no matter what Nick Hogan says, he won't be there then."
He added "There are two courses of action open to him and if he takes the wrong one, he could end up with nothing."
