Standard cover

Our commercial landlord's insurance policy covers the following as standard:

Property damage - Covers loss or damage caused by a number of situations including fire, lightning and explosion; storm or flood; escape of water from tanks, apparatus or pipes; impact by vehicles; theft or attempted theft following forcible and violent entry to or exit from your premises; accidental damage and subsidence. Cover includes professional fees, removal of debris costs and alternative residential accommodation where the residential parts of the building is unfit for occupation and damage to grounds resulting from damage to the buildings.

Property Owner's Liability - Provides £2m cover for sums you become legally liable to pay in respect of accidental injury to any person or accidental loss or damage to their material property happening in connection with the properties insured.

Legal Expenses - Covers costs and expenses of certain legal actions that may arise plus a 24 hour legal helpline.

Optional extras

For an additional premium you can also select a range of optional extras to add on to your landlord insurance policy, for an additional premium:

  • Loss of rent - covers loss of rental income following damage to the buildings or contents by any cause covered by the Property Damage section. Options of 12, 24, 36, 48 or 60 months indemnity period.
  • Employer's Liability - Provides cover of £10m for sums you become legally liable to pay as damages together with your legal costs and expenses relating to an injury to an employee for which you are found to be negligent.
  • Subsidence - cover against damage to your premises due to subsidence, ground heave or landslip.
  • Terrorism - additional protection against damage to your premises from acts of terrorism (subject to acceptance).
  • Personal Accident - cover for principals, directors and partners aged no more than 65 years old that provides compensation arising from any accident at any time. Death or permanent total disablement £20,000 capital sum.

Basic cover provides you with the legal advice and protection from the professional costs and expenses of legal actions which may arise including:

  • Employment contract - covers the cost up to £100,000 of defending disputes relating to contracts for full or permanent part time employment. Cover includes any resulting award a court or tribunal orders you to pay.
  • Tax and VAT - covers the costs up to £100,000 of an appeal against the Inland Revenue or HM Customs following an in-depth investigation into your most recent PAYE, business tax or VAT accounts.
  • Legal advice help line - access to Law phone which provides advice on all business related legal matters
  • Prosecution defence - covers costs up to £100,000 for defending your legal rights after an event which arises out of your business activities as a landlord and results in criminal proceedings.
  • Property - covers the costs up to £100,000 of taking legal action relating to damage to your business premises.
  • Jury service - provides up to £100 per day to cover any shortfall in your salary or wages as a result of attending jury service

Cover can also be extended to include the following:

  • Data Protection - Cover up to £100,000 for any one claim in respect of your legal costs to:
    • Defend you in a dispute relating to the Data Protection Act 1998.
    • Appeal against a refusal of an application for registration or alteration of your registered particulars.
    • Appeal against an Enforcement, De-registration or Transfer Prohibition Notice.
    • Pay compensation awards against you relating to the holding, loss or unauthorised disclosure of data under Data Protection legislation.
  • Commercial tenancy disputes - costs up to £100,000 in taking legal action over the agreement under which you let property to the tenant of non residential property.
  • License protection - costs up to £100,000 of defending the withdrawal, restriction or suspension of your business license.
  • Personal injury - covers costs up to £100,000 of taking legal action against another person who causes death or bodily injury to you
  • Witness Attendance Allowance - Cover up to £5,000 for any one Event in respect of the salary or wages of an employee that you cannot get back from the court, tribunal or arbitration.

Exclusions & limitations

The following exclusions and limitations apply to the landlord's legal expenses cover:

Employment contract cover exclusions include:

  • disputes which occur within the first 3 months of cover
  • disputes with an employee who was subject to a warning in the 6 months preceding the inception of this cover
  • disputes over redundancy
  • any dispute that you have not discussed with Lawphone before you take any action
  • disputes involving sub-contracting or contracts for services with self-employed persons
  • You are responsible for the first £1,750 of each claim.

Property cover exclusions include:

  • claims relating to mining or subsidence
  • You are responsible for the first £500 of each claim.

Prosecution Defence cover exclusions include:

  • allegations of dishonesty or intentional violence
  • You are responsible for the first £500 of each claim.

Tax and VAT cover exclusions include:

  • representations during an in-depth investigation
  • anything to do with an investigation by the Inland Revenue Special Investigation Section or Special Compliance Office

License Protection cover exclusions include:

  • hearings arising out of any commercial decision made by you
  • the first application for, or standard renewal of the license
  • anything to do with drug offences
  • anything to do with under age drinking
  • You are responsible for the first £500 of each claim.

Personal injury cover exclusions include:

  • personal injury disputes between you and any employee(s)

Exclusions applicable to all covers include:

  • anything relating to franchise or distribution agreements
  • disputes over rent, business rates or service charges
  • any injury, damage, prosecution or appeal relating to owning or using a motor vehicle
  • disputes relating to share rights
  • Any one claim limit £100,000. Period of Insurance aggregate limit £500,000

Exclusions & limitations

These are some of the exclusions that apply to the policy. There are also further provisions such as those relating to under insurance as well as general conditions and exclusions. Details of these can be found in the policy document. Other additional terms & conditions may be applied in certain cases. Excesses apply to certain types of claim.

Property damage excludes:

  • Storm, theft, accidental/malicious damage, burst pipes or sprinkler leakage in an unoccupied building. See policy condition 13 for terms & conditions.
  • Theft of contents not involving forcible and violent entry to or exit from the premises, or to items in gardens or landscaped areas. See Event 11 of Section 1 for terms & conditions.
  • Storm, tempest or flood to fences, gates and property in the open. See Event 7 of Section 1 for terms & conditions.

Felt Roof Condition - you must ensure that any felt roof over seven years old is inspected annually and any remedial work required completed. See Condition 3 of Section 1 for terms & conditions.

Property Owner's Liability excludes:

  • Asbestos - we will not be liable for legal liability in respect of injury loss or damage directly or indirectly caused by arising from in consequence of or in any way involving asbestos.

    Provided that this exclusion shall not apply to liability for injury or loss of or damage caused by any commodity article or thing containing asbestos where the presence of asbestos is not in itself a direct or indirect cause of such injury or loss or damage.
